  • Order 43 of 2022 Article 6 refers controllers to Article 5 of Order 42 of 2022 (transfer outside Bahrain) when contracting external processors.

In Practice

What This Means for Your ERP

  • Record the hosting and backup country of each ERP environment and which transfer basis (adequacy, consent, Authority authorisation) applies.
  • Flag cloud, support or AI-service integrations that send personal data abroad so legal review happens before go-live.
  • Keep processor contracts reflecting Order 42 requirements, and consent records where consent is the basis.
  • Store the date and result of any Authority authorisation or processing notification against the integration record.
