What the Official Sources Say

  • PDPL Article 12: transfers outside Bahrain are prohibited unless the destination is on the Authority's adequacy list published in the Official Gazette, or the Authority authorises case by case.
  • PDPL Article 13: transfer to a non-adequate country is allowed with the data subject's consent or on other grounds listed in that Article.
  • PDPL Article 13: the Authority may authorise transfers to non-adequate countries where the controller shows adequate safeguards, for example by contract, subject to conditions.
  • PDPL Article 14: prior notice of automated processing to the Authority must include any proposed transfer of data outside the Kingdom (unless a Data Protection Guardian is appointed).
  • Order 43 of 2022 Article 6 refers controllers to Article 5 of Order 42 of 2022 (transfer outside Bahrain) when contracting external processors.

In Practice

What This Means for Your ERP

  • Record the hosting and backup country of each ERP environment and which transfer basis (adequacy, consent, Authority authorisation) applies.
  • Flag cloud, support or AI-service integrations that send personal data abroad so legal review happens before go-live.
  • Keep processor contracts reflecting Order 42 requirements, and consent records where consent is the basis.
  • Store the date and result of any Authority authorisation or processing notification against the integration record.
